Tour d’Elegance

I grant the La Jolla Concours d’Elegance , its representatives and employees the right to take photographs of me, my car, and my property in connection with the above-identified subject. I authorize La Jolla Concours d’Elegance, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that La Jolla Concours d’Elegance may use photographs of me or my pet, with or without my name and for any lawful purpose, including (for example) such purposes as publicity, illustration, advertising, and web content.

As we strive to keep our event fresh and not display the same cars every year, we request you honor our three-year rule.

The following Hold Harmless agreement is an essential part of this participation form. The undersigned hereby agrees to hold harmless and indemnify the La Jolla Concours d’Elegance, La Jolla Historical Society, McFarlane Promotions Inc., and the City of San Diego and any/all event committee members from any costs, losses, damages, injuries, litigation and liability arising out of or related to the activities and use of public or private property by the undersigned, and the agents and employees of the undersigned, at the above described event.

I understand entering my vehicle into the La Jolla Concours d ‘Elegance. Please check that you understand no refunds will be offered and all sales are final. A list of hotels that you can book your stay at is located on the accommodations page of the La Jolla Concours website. Please make sure when making your reservations to check the cancelation policy. Thank you again for registering your vehicle in the La Jolla Concours d’Elegance, and we appreciate your support of the La Jolla Concours d ’Elegance.

I, the Exhibitor, hereby agrees to indemnify, defend and hold the La Jolla Historical Society, McFarlane Productions Inc., their officers and agents (all hereinafter referred to as the “La Jolla Historical Society”) harmless from any loss, liability, costs, attorneys’ fees, or damages arising from actual or threatened claims or causes of action resulting from the negligence or intentional actions of the La Jolla Historical Society or the Exhibitor, or each’s respective officers, contractors, members, guests, volunteers, or participants, including any indirect, consequential, or punitive damages. Any controversy, claim, or dispute arising from or relating to this Release and/or the La Jolla Historical Society shall, at the option of the La Jolla Historical Society, be settled through nonbinding mediation or binding arbitration conducted in accordance with the rules of the American Arbitration Association or through an action brought in any court of competent jurisdiction. In connection with any such mediation, arbitration or court action, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs. THE EXHIBITOR EXPRESSLY WAIVES THE RIGHT TO A TRIAL BY JURY. The Exhibitor gives permission to the La Jolla Historical Society and McFarlane Promotions for the use of any photographs and information supplied by the Exhibitor, and to take any photographs of me and my property and to use such photographs or information with or without my name. I authorize the La Jolla Historical Society, its assigns and agents to copyright, use and publish the same in print and/or electronically. I have read the above and accept the terms and conditions.
